Subject

Trayyce checks publicly reachable websites for security-relevant settings and shows the result as a report. The check and the provider directory are free and need no account. If a check through the public form produces a grade, we add the checked website with that grade to the public provider directory; the exceptions are listed in the privacy policy. The tools in the customer area require an account that we set up. With a code from our partner Closing-Empire you can also search for your own data online at trayyce.io/d and prepare removal requests (section “Privacy check with a code”).

Paid packages and add-ons are only available to businesses (section “Paid packages”).

Permitted use

Only check addresses that are publicly reachable. Automated mass queries, getting around the limits and attempts to use the check for attacks on other systems are not allowed. You may link to and share reports; you may embed verification badges the way we provide them.

Limits

Each visitor can run six checks in ten minutes and 30 a day, each address can be checked 20 times a day, and 300 checks per hour are possible for everyone together. When a limit is reached, Trayyce temporarily declines further checks.

Privacy check with a code

You get the code from an adviser from our partner Closing-Empire. With this code the check is free for you, and you do not need an account.

By starting the check you enter into a free contract with us for this check. You can use it from the age of 18.

Only search for your own data. You must not enter details about other people. Trayyce shows you search links and prepares requests to people-search sites, credit agencies and data brokers. You have to send the requests yourself. We cannot influence whether and when a provider answers or deletes your data.

The requests are templates under the GDPR. Trayyce does not examine your case legally and does not advise you. The providers' addresses come from our own list; if a provider changes its address, a request may bounce.

You can delete your case at any time with your link in the browser in which you started it. Otherwise we delete it 90 days after the last change (start, saving, ticking off, finishing). How we process your details is described in the privacy policy.

Cancellation policy for the privacy check

This policy applies if you use the privacy check with a code as a consumer.

Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded, that is from the start of the check.

To exercise your right of withdrawal, you must inform us (Kevin Feiler Einzelunternehmen, trading as Trayyce, Königstraße 5, 70173 Stuttgart, Germany, phone +49 711 25267505, email info@ddevelopment.de) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form in the next section, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal: If you withdraw from this contract, we delete your case with all details. Because the check is free, there is nothing to refund and no compensation for value. The quickest way is “Delete case” in the case itself; it takes effect immediately. If you withdraw by letter or email, please include your link so that we can find the case. Without it we cannot identify the case; it is then deleted 90 days after the last change.

Model withdrawal form

(Complete and return this form only if you wish to withdraw from the contract.)

To Kevin Feiler Einzelunternehmen, trading as Trayyce, Königstraße 5, 70173 Stuttgart, Germany, email info@ddevelopment.de:

Paid packages

Packages (Pro, Agency, Enterprise) and add-ons (Domain Lock, private reports, keyword suggestions) can only be booked by entrepreneurs within the meaning of § 14 BGB, legal entities under public law and special funds under public law. Before booking you confirm in the customer area that you are booking for a business; in the checkout you enter the billing address and, if available, your VAT ID. Consumers cannot book packages.

The contract is concluded when you complete the payment in the checkout of our payment provider Stripe. What a package includes is shown in the package overview in the customer area at the time of booking. The price shown in the checkout applies; it also states whether VAT is added. Payment and invoices are handled by Stripe.

Subscriptions run for the billing period stated in the checkout and renew for the same period unless you cancel. You can cancel at any time in the customer portal; cancellation takes effect at the end of the current period, and the package remains usable until then. Domain Lock is a one-off purchase for one domain without a term and applies as long as we operate Trayyce.

If a payment fails, Stripe tries again. If it is not made, the package features end three days after the end of the paid period.

We only change prices of running subscriptions with notice by email at least six weeks in advance. You can cancel until then; otherwise the new price applies from the next billing period. We can discontinue a package or Trayyce as a whole with three months' notice; we refund amounts paid in advance for the time after that.

You use leads, research results, bots and channels on your own responsibility. You may only contact people where the law allows it, in particular under § 7 UWG and the GDPR; advertising by email, phone or messenger without consent is not allowed. You may only embed a verification badge for your own verified domains. It shows the grade of the latest check and is not a promise that your website is secure.

In the event of a serious breach of these terms, for example attacks via Trayyce or unlawful advertising to contacts from Trayyce, we may block access and terminate the contract without notice.

Data processing on your behalf

If you process personal data of other people with the tools in the customer area, for example in the privacy tool or via the contact form for your website, we do so on your behalf. Our data processing agreement at trayyce.io/en/auftragsverarbeitung applies to this. It is part of these terms and takes precedence over them in matters of data protection.

No warranty

A report is a snapshot of what the server sends publicly at the time of the check. It replaces neither a penetration test nor professional advice. We cannot promise that every check is complete and error-free or that the service is always available.

Liability

We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.

Beyond that, we are not liable for free use, that is the check, reports, the provider directory and the privacy check with a code.

Towards customers with an account, we are liable for slight negligence only if we breach an essential contractual obligation, meaning an obligation that makes performing the contract possible in the first place and on whose fulfilment you may regularly rely. Liability is then limited to the damage that was typically foreseeable when the contract was concluded. Otherwise we are not liable for slight negligence.

These rules also apply to the personal liability of our employees and agents.

Changes

We may change these terms, for example when new features are added. For free use, the version shown on this page at the time of use applies, and for a started privacy check the version at the start. For customers with an account, changes only apply once they have agreed to them; for prices, the section “Paid packages” applies.

Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence.

If you are a merchant, a legal entity under public law or a special fund under public law, Stuttgart is the place of jurisdiction for all disputes arising from the use of Trayyce.

Dispute resolution

We do not take part in dispute resolution proceedings before a consumer arbitration board.
